A. Terms and Conditions of agreeing to supply You with Artwork

The Privacy and Security of Your information

(How We may use the information that You give to Us which identifies You.
We will never ask for any unnecessary personal information from You. You can Contact Us and ask Us at any time: - to see what personal information We hold about You; or
to ask Us to amend any of Your personal information if You think it is wrong or it has changed since You last contacted Us.

We may contact You in any manner You allow as it may be necessary to clarify any Order that You send Us or any query We may have in Order to provide You with the best possible service.

Your personal information will be stored in a safe and secure manner where it cannot be accessed by unauthorised persons. All of Your personal information is Backed Up on systems which are regularly reviewed for security reasons.

The Contract

The placing of an order implies acceptance of these terms and conditions. Work should be accompanied by an official order form and signed by an authorised person. Verbal/email instructions are accepted on the basis that Uconic Portraits will not be held responsible for any error that may arise. Uconic Portraits shall be entitled to sub-contract any service it agrees to perform.

An order and the acceptance of a quotation must be accompanied by sufficient information to enable Uconic Portraits to fulfil the order and both parties must agree any modifications in advance. Uconic Portraits must have the fullest details of a request to ensure an accurate quotation. Subsequent variation to the specification contained within a description may lead to additional charges. Uconic Portraits will only create work based on the chosen photograph of the customer. Additional charges will be incurred if, after work has been carried out, an alternative photograph is chosen.

You must be over the age of 18 years old if You wish to place Order through Us.

Orders are subject to acceptance and availability of the Artwork ordered.

We are entitled to reject any Orders for any reason.

No Contract will subsist between You and Us for the production and or despatch of any Artwork unless and until We accept Your Order. We will do this by informing You that Your Artwork will be dispatched.

Our acceptance however made will be deemed for all purposes to have been effectively communicated to You.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between You and Us) shall not apply unless they are agreed in Writing by Us.

Any typographical, clerical or other error or omission in any description of the Artwork on the Website or in any Order, Price list, acceptance of offer, invoice or other document or information issued or published by Us shall be subject to correction without any liability on Our part.

All stated print and trim sizes are nominal and Uconic Portraits will accept no liability for minor variations in size.

It is the responsibility of the customer to ensure that all material presented for photography, printing, copying, duplicating or any other form of reproduction is free from any third party claims for breach of copyright or license.

Payment

All Our prices are in British Pounds (GBP).

Notice of the despatch of Your Order will only be given to You after Your payment has cleared.

We only accept payment in full by cheque, bankers draft or direct electronic payment into Our Bank Account.

We will not be responsible for any fees charged by Your bank.

If Your payment is rejected by Our bank for any reason and We are charged any fees, We will request that You refund such fees to Us before We process Your Order any further.

We retain the right to modify the Price applicable to Your Order if You amend Your Order (once it has been sent to Us) and or We foresee additional out of pocket expenses for the materials necessary to process Your Order which We shall notify to You as soon as possible.

Without prejudice to other remedies, Uconic Portraits shall in respect of all unpaid debts due from the customer, retain title to the goods until such debts are paid. In the event of a customer being unable to pay debts, Uconic Portraits may recover the goods which are it property by virtue of this clause by means it deems necessary.

Delivery

Delivery of the Artwork shall be made to the address notified by You on any Orders and the Order Confirmation.

Delivery will be made by a reputable national delivery company.

Goods will normally be delivered to You within 30 days of Us accepting Your Order. We will pass on any delivery dates and times to You as and when We are notified by our national delivery company.

If We become aware of any delay which will result in the Artwork reaching You after more than 30 days We shall inform You. If the delay is unacceptable You may cancel Your Order with Us and pay nothing.

You must ensure that the Intended Recipient is available to take delivery. If the Intended Recipient fails to take delivery or fails to give Us adequate delivery instructions, We have the right to charge You for the delivery whether included in the Price or not.

The Intended Recipient must take a few moments to inspect the packaging prior to signing for it, and accepting delivery of the Order.

If the packaging is damaged the Intended Recipient must open it immediately, in the presence of the national delivery company representative, before signing for it.

Once opened the contents must be inspected and if they are damaged the Intended Recipient must refuse to accept delivery due to the contents being damaged in transit from Us to that Intended Recipient.

You or the Intended Recipient must then Contact Us immediately informing Us of the details so that We may then enquire with the national delivery company.

You or the Intended Recipient must Contact Us in any event within 24 hours of delivery as We will not accept liability for any damage to the packaging or Artwork after this time.

We will then advise You or the Intended Recipient on the next steps as appropriate.

Cancellations

If You have received the Artwork and You wish to cancel the Contract, the Consumer Protection (Distance Selling) Regulations 2000, allows You to do this in Writing by sending a notice of cancellation to our customer services desk (see Contact Us). We must receive the notice of cancellation within 7 days of the date of delivery of the Artwork.

As soon as We receive Your notice of cancellation We will contact You to confirm receipt of Your notice of cancellation, inform You of the arrangements for collecting the Artwork from the Intended Recipient and will refund the amount You have paid less any charges for delivery back to Us within 30 days by cheque.

Such refund will end Our liability to You.

Quality Process

We only use the best quality processes and the most appropriate materials in the production of Our Artwork. All Artwork and packaging is done by the artist by hand to ensure the highest standards throughout. Everything is thoroughly inspected by the artist prior to dispatch for Your peace of mind.

Uconic Portraits are not responsible for the care and handling of any prints once received by the customer. Uconic Portraits are not liable for damage caused by third parties. Uconic Portraits do not add any protective laquer or covering to finished artwork and if required such protection must be carried out by the customer at the discretion and risk of the customer. Life expectancy and performance of any artwork is based on manufacturers and suppliers claims. Uconic Portraits are not liable for any deviation in quality or consistency of its artwork.

Uconic Portraits will return original photographs/ disks to customers.

Product Specification

We would like to be totally satisfied with the Artwork that We supply to You. For this reason We will provide You with a Proof of the Artwork for Your approval before requesting that You place an order by returning the Order Confirmation together with payment.

We make every effort to produce the Artwork as shown on the Website and the Proofs, but we have the right to dispatch Artwork subject to minor variations in actual specifications ­ Artistic Licence, used in order to create the best piece of artwork and totally at Our discretion. Please Note that because of this, the colour and appearance of artwork and canvas may vary slightly from the way they appear on the website or the Proof.

Authenticity

All Artwork on Canvas is signed by the artist and branded with the website address as a certificate of authenticity.

Intellectual Property

All Intellectual Property and rights associated with the Intellectual Property In the Content of the Artwork or Website remain with the artist even after You have purchased the Artwork and the Contract between Us is completed.

Reproduction, Distribution and Modification of any part of the Website or Artwork is expressly prohibited for any purpose without express written agreement from Us.

Warranties and Liabilities

The Contents of the Website and Proofs are for guidance only, and should not be relied on to determine either the tone or the colour of any item.

All Warranties, conditions and other terms implied by statute or common law are excluded to the fullest extent permitted by law and in any event Our entire liability under or in connection with these Terms and Conditions shall not exceed in aggregate the Price of the relevant Artwork.

Complaints

We value Your custom and would hope that You continue to purchase Artwork from Us or recommend Us to Your friends and family. If for any reason You have a complaint about Our service, please Contact Us. We aim to respond to all complaints promptly.

Technical Problems and Comments

If You encounter any technical problems with the Website or have any comments concerning the Website or Our Artwork please Contact Us.

Applicable Law

You agree with Us that English law shall apply to these Terms and Conditions and You also agree with Us that any Court action may take place in the Courts of any country (including in England) regardless of the law which applies to that country.
